Terms of Use

These terms are the agreement between you and Frazzle for using the app. They explain what Frazzle is and is not, how the subscription and free trial work through the App Store and Google Play, what happens with your data, and your rights under the Australian Consumer Law. Please read them, and our Privacy Policy, before you use the app.

You can read these terms without an account and without a subscription. Crisis and safety resources, and your Settings, are always reachable in the app regardless of whether you subscribe. If you do not agree to these terms, please do not use Frazzle.

1. About these Terms

These Terms of Use govern your access to and use of the Frazzle mobile application, its content, features and related services.

Frazzle is operated by Nitin Gupta trading as Logicnest Analytics, ABN 83 843 886 898, of NSW 2765, Australia. In these Terms, "Frazzle", "we", "us" and "our" refer to Nitin Gupta trading as Logicnest Analytics. "You" means the person using Frazzle.

By downloading, accessing or using Frazzle, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Frazzle.

You must be at least 18 years old and legally capable of entering into this agreement. Frazzle is designed for parents and adult caregivers. It is not intended to be used independently by children.

2. What Frazzle provides

Frazzle provides general parenting education, preparation and practice tools for adult parents and caregivers. Depending on your subscription and the features available in your version of the app, Frazzle may provide:

Frazzle provides ideas and tools that you may choose to try. It does not provide instructions that must be followed, and it does not guarantee a particular parenting or behavioural outcome.

We may improve, add, remove or modify content and features over time. We will not deliberately remove the essential benefit of a paid subscription without providing a materially equivalent service or any remedy required by law.

3. Frazzle is not a medical or emergency service

Frazzle provides general educational information. It does not provide medical, psychological, psychiatric, diagnostic, therapeutic or other professional health services. Frazzle does not:

Do not rely on Frazzle when making a medical, mental health or safety decision. Seek advice from a qualified professional if you have concerns about your child's health, development, behaviour or safety.

If you or your child are in immediate danger, contact local emergency services. In Australia, call 000. Crisis and safety information within Frazzle remains available without a paid subscription, but Frazzle cannot guarantee that any third-party telephone or support service will always be available.

4. Your responsibility when using Frazzle

You remain responsible for decisions concerning your child and family.

Parenting situations differ. An approach presented in Frazzle may not be suitable for every child, age, developmental stage, family, culture or circumstance. Use your judgement and stop using an activity or suggestion if it appears unsafe, inappropriate or unhelpful.

You must provide appropriate adult supervision during any activity involving a child. Do not use your phone or Frazzle in a way that distracts you while driving, supervising a hazardous activity or responding to an emergency.

5. Access without a subscription

Frazzle may allow you to browse parts of the app before subscribing. Browsing may show scenario names, feature descriptions, previews or other introductory material, while restricting access to the underlying content or actions.

Local information is normally stored on the device on which it was created. A subscription does not, by itself, synchronise plans or history between devices.

6. Subscriptions

Frazzle offers auto-renewable monthly and annual subscriptions through the Apple App Store and Google Play.

An active subscription provides access to Frazzle's subscriber features for the applicable subscription period. Monthly and annual subscriptions provide the same level of access unless the purchase screen expressly states otherwise.

The current price of each plan for your region, together with any applicable taxes, is displayed in your local currency by the relevant app store before you confirm your purchase. The price and terms the store shows at the time you confirm the purchase govern the transaction.

Payment is charged to the store account you use to confirm the purchase. We do not directly collect or store your payment card information.

7. Fourteen-day free trial

Eligible new subscribers may be offered a 14-day free trial through the Apple App Store or Google Play. When a free trial is available:

Free-trial eligibility is determined by the app store. Generally, a person may use only one introductory offer within the same Apple subscription group or equivalent Google Play subscription arrangement.

If the store determines that you are not eligible for a free trial, the store purchase screen will show the amount payable before you confirm the subscription. The store purchase confirmation is authoritative if it differs from an earlier eligibility indication shown inside Frazzle.

8. Automatic renewal and cancellation

Your subscription automatically renews for successive monthly or annual periods unless you cancel it through the store that processed the purchase. You can manage or cancel your subscription through:

Deleting Frazzle, deleting local data or ceasing to use the app does not cancel a subscription.

To avoid the next charge, cancel within the time required by the relevant store. Apple generally requires cancellation at least 24 hours before the end of the current trial or billing period.

After cancellation, access normally continues until the end of the trial or paid subscription period shown by the store. Cancellation does not ordinarily produce a pro-rata refund for an unused part of a billing period, except where required by law or permitted by the applicable store.

9. Changes to subscriptions and prices

We may change future subscription prices or plans.

Any price change will be administered through the applicable app store. The store will provide any notice or obtain any consent required by its rules or applicable law. A changed price will not apply contrary to the price-protection, notice or consent rights provided by the store or applicable law.

If we make a material change to the subscriber service, we will provide reasonable notice where practicable. If a change materially disadvantages you, you may cancel before your next renewal. Nothing in this section limits a right or remedy you have under applicable consumer law.

10. Billing problems, restoration and refunds

Access may be interrupted if a payment fails, a transaction remains pending, the store revokes or refunds a transaction, or the store cannot verify your entitlement.

Your subscription is associated with the Apple Account or Google Play account used for the purchase, rather than with a Frazzle account or a particular device. If you previously purchased a subscription using the same store account, use "Restore Purchases" in Frazzle. On a replacement or additional device signed in to that same store account, Restore Purchases can restore eligible subscription access, including any remaining eligible trial period.

Restoration restores subscription access only. It does not restore child profiles, plans, personalisation answers, reminders, reflections, Journey history or other information created on a previous device, because that information is stored locally and is not synchronised to an account. See section 12.

Restoration has limits you should understand:

Apple and Google process payments, cancellations and store refunds. You may request a refund through the store that processed your purchase.

Store refund rules do not exclude any rights you may have under the Australian Consumer Law or another applicable law. You may also contact us at support@frazzleapp.com if the service has not been provided as represented.

11. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified within a reasonable time. If this is not done, you are entitled to cancel the contract and obtain a refund for any unused portion.

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

12. Privacy and local data

Our Privacy Policy explains how Frazzle handles data and forms part of these Terms. It is available at https://frazzleapp.com/privacy.

Frazzle is designed to be local-first. Parenting profiles, plans, answers and history are generally stored on your device and are not synchronised to an account.

Frazzle may use service providers for limited functions including subscription verification, app integrity, content delivery, optional analytics and crash diagnostics. The Privacy Policy identifies the applicable categories of data, purposes and service providers.

You can access available export and deletion controls through Frazzle's Settings. Deleting local data is permanent and may not be reversible. Deleting local data does not cancel your subscription.

13. Reminders and notifications

Frazzle may offer optional local reminders. Reminders are off until you choose to enable them and grant any required device permission. You can turn reminder categories off within Frazzle or disable notifications through your device settings.

Notifications are an optional supporting feature. Delivery may be affected by device settings, battery restrictions, operating-system behaviour, time-zone information or whether you reopen the app.

Do not rely on a Frazzle reminder for an emergency, medical need, essential appointment or safety-critical task.

If your subscription ends, premium reminders may pause while the underlying local schedule remains stored on your device.

14. Intellectual property

Frazzle and its original software, designs, text, audio, illustrations, exercises, games, trademarks and other content are owned by us or licensed to us and are protected by intellectual property laws.

Subject to these Terms and the applicable store licence, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to use Frazzle for your own non-commercial parenting and caregiving purposes. You must not:

You retain ownership of information you enter into Frazzle. You give us only the limited rights reasonably necessary to process that information on your device and provide the requested functionality.

15. Third-party services and app stores

Frazzle may depend on services operated by Apple, Google, Firebase, RevenueCat or other providers. Those services may be governed by their own terms and privacy policies. You must comply with applicable third-party terms when using Frazzle, including the terms of the app store from which you obtained it.

For an Apple App Store download, your licence to use the app is Apple's standard Licensed Application End User Licence Agreement. We do not provide a custom licence agreement.

Apple and Google are not responsible for Frazzle's parenting content or for advice, support or claims relating to that content.

Links or telephone details for third-party organisations are provided for convenience. We do not control those organisations and cannot guarantee their availability or the accuracy of information they independently provide.

16. Availability and updates

We aim to keep Frazzle available and functioning, but continuous or error-free availability cannot be guaranteed. Features may occasionally be unavailable because of maintenance, store outages, network conditions, third-party service failures or circumstances outside our reasonable control.

Some content must be downloaded before it is available offline. Cached or downloaded content may continue to work without a connection, but subscription verification and new downloads may occasionally require internet access.

You are responsible for installing supported updates. We may stop supporting an old version where reasonably necessary for security, compatibility or service operation. Where practical, we will provide reasonable notice before requiring an update.

17. Suspension and termination

You may stop using Frazzle at any time. You remain responsible for separately cancelling an active subscription through the relevant app store. We may restrict access where reasonably necessary to:

Where reasonably possible, we will provide notice and an opportunity to remedy the issue. We will not use this section to avoid providing paid services or remedies required by law.

Sections concerning safety, intellectual property, consumer rights, liability and disputes continue to apply where their nature requires them to survive termination.

18. Disclaimers and liability

Parenting outcomes depend on many circumstances outside our control. To the extent permitted by law, we do not guarantee that Frazzle will prevent difficult behaviour, improve a relationship or produce a particular result. You are responsible for deciding whether and how to use any idea presented by Frazzle.

To the extent permitted by law, we are not responsible for loss caused by:

We do not exclude responsibility for loss that was reasonably foreseeable and caused by our failure to comply with applicable law, or any other liability that cannot lawfully be excluded. Nothing in these Terms excludes liability for fraud, wilful misconduct or personal injury where exclusion would be unlawful.

19. Changes to these Terms

We may update these Terms to reflect changes to Frazzle, store requirements, business operations or applicable law. The updated Terms will show a new effective date. If a change materially affects your rights or an active paid service, we will provide reasonable notice through the app, website or another appropriate method.

Changes will operate prospectively unless a retrospective change is required by law. We will not use this section to retrospectively remove an accrued consumer right or avoid an existing obligation. If you do not agree to materially changed Terms, you may stop using Frazzle and cancel your subscription before its next renewal.

20. Complaints and disputes

Please contact support@frazzleapp.com first so we can try to resolve your concern. Nothing in these Terms requires you to use an internal complaint process before exercising a legal right or contacting a regulator, consumer-protection body or court.

Australian consumers may also contact NSW Fair Trading or the Australian Competition and Consumer Commission for information about consumer rights.

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales and any other court with lawful jurisdiction may hear disputes relating to these Terms.

21. General provisions

If a provision of these Terms is unlawful or unenforceable, it will be read down to the extent necessary or severed where reading it down is not possible. The remaining provisions continue to apply.

Our failure to enforce a provision on one occasion is not a waiver of that provision.

We may transfer these Terms as part of a genuine sale, restructuring or transfer of the Frazzle business, provided that the transfer does not reduce your rights under applicable law. You may not transfer your rights under these Terms except where applicable law or store rules permit it.

These Terms, the Privacy Policy, the applicable store purchase terms and the applicable app licence constitute the agreement relating to your use of Frazzle. If they conflict, mandatory law applies first, followed by the store's terms for the store transaction, and then these Terms for Frazzle's service and content.
